1971 – A Benchmark Year for Asbestos Litigation

by: Wendy Moyer
Many asbestos manufactures and other companies that used asbestos in their products have known about the dangers associated with asbestos exposure since the early part of the twentieth century. Nonetheless, because of its unique properties, the demand for products that incorporated asbestos continued to grow for many years. And these companies continued to do whatever they could to satisfy that demand.

Demand for asbestos peaked between World War II and the Korean War.

By then millions of asbestos workers had been exposed to asbestos fibers. And countless millions of people who were not in the industry were exposed to the substance in their offices, schools, homes, and automobiles.

Asbestos companies and insurance companies were well aware of the dangers associated with asbestos inhalation for many years. Yet they chose to hide the evidence and deny any wrongdoing on their part. Instead, these companies chose to put their workers health at risk in their pursuit of profit.

Things changed dramatically in 1971 when a Federal court reviewed a product liability case and issued the first verdict against an asbestos manufacturer. The court also decided to award the employee who filed the complaint damages.

Subsequently the ruling was appealed. However, the verdict was upheld.

This seemed to open a floodgate to asbestos litigation.

Even in the face of this decision asbestos companies chose to fight back.

Instead of acknowledging all of the detrimental effects exposure to asbestos had wreaked on their workers lives, manufactures instead decided to defend against the rising flood of complaints. Instead of doing things that could protect their workers, things that could help to alleviate the dangers their employees faced at work every day, the manufacturers “battened down the hatches”, denied responsibility, and “dug in”.

The courts continued to rule against asbestos manufacturers and continued to award payments to the workers who were losing their health, their livelihood, and their lives.

With ever increasing award payments and legal bills, asbestos companies searched for a different approach. Bankruptcy seemed to be a solution.

UNARCO and Johns Manville were the first asbestos companies to file for Chapter 11 bankruptcy protection in 1982. Since that time in excess of eighty companies have filed for bankruptcy.

Companies that declare bankruptcy seemingly as an attempt to reorganize their finances and buy some time. Ostensibly this is so they can pay the liability claims for asbestos that the courts have awarded.

When a company files for Chapter 11 protection, the filing will suspend any future or pending lawsuits against that company for the duration of the bankruptcy case. The company essentially asks the court to authorize a plan that will include the establishment of a settlement trust fund.

The company’s strategy will redirect on any future claims that are filed against company to the trust.

The asbestos bankruptcy trust funds that have been established operate under rules that make sure that the funds within them are available for claims in the future. Over $30 billion has been made available within these trusts.

This can actually benefit people who have suffered from an asbestos related disease but who have missed the time frame within which they should have filed a lawsuit. That’s because even if the statute of limitations has passed for filing a claim against a company the window still could be open for filing a lawsuit against the trust.

Here’s a list of tips for using the social marketing tool to make money online:

1. Tweet every time you update your blog. Put the link with a catchy headline and people could stop by for a read.

2. Search the tool, http://search.twitter.com for your niche and see who has tweeted about that topic recently. Do follow your competitors too. Follow them and send them an @username message. If they reply directly and @username reply to you, this could also get you new followers because people who follow them could see your tweet and click your profile out of curiosity.

3. Put your URL in your profile. This can get you traffic!

4. Be an interesting Tweeter. Answer questions, be witty and helpful and you could make friends who might buy stuff!

5. Update Twitter every time you are promoting something. If you’re doing the other things listed here, you’ll probably get some hits and perhaps some sales as well.

6. Ask for feedback on your new site. People will visit, give you feedback and might subscribe or sell something.

7. Publish a link every time you update your newsletter. You might get new opt-ins, especially if you put a teaser in your tweet!

8. Feed your articles to Twitter. You can feed sites like ezinearticles.com where you might do article marketing to Twitter to help you get more traffic to your articles.

9. Arrange local meet ups in your area to meet with peers or potential clients at a coffee shop or talk about a local event you’re holding. Offer free or discounted admission if someone tweets for you.

10. Use Twitter to ask for social bookmarking like StumbleUpon or Digg on articles or blog posts you’ve written. Return the favor!

You’ve signed up for Sponsored Tweets and now you’re waiting for the advertisers to order some paid tweets from you so you can start making the $300 to $7,500 an hour I talked about in the easiest way to make money with Twitter post. However, you haven’t gotten one single offers. What’s going on? Here are ten tips to increase your chances of getting a sponsored tweet.

1 – Experience Counts

If you’re brand new to Twitter, then your chances of an advertiser ordering a paid tweet from you is slim to none. Your Twitter account should be at least 120 days old before applying to Sponsored Tweets as most advertisers simply will not buy tweets from any accounts that are younger than that.

The account age is valuable for advertisers to filter out spammers and low value Tweeters. If someone has a high number of followers and just recently created an account it may be reason for suspicion. If your Twitter account is brand new, don’t apply.

2 – Have a Complete Twitter Profile

Advertisers like to know who they’re advertising with. If your Twitter profile is incomplete and still running the default background, don’t expect many orders. You don’t have to get a custom Twitter background like what I used but you should make sure all your information is filled out. Make sure you upload your photo or custom avatar as well.

3 – Add Sponsored Tweets To Your Advertise Page

If you’re going to accept Sponsored Tweets, then you might as well tell your advertisers about it. You can use your advertise page to list the benefits of using your Twitter account to help get the advertiser’s message out. Then you can link to the Sponsored Tweets website so they can order.

4 – Show Some Tweet Click Stats

If you use Hootsuite as your Twitter client (and you should if you’re not) then you can take advantage of its built in stat tracking feature. This is a great way to show advertisers that your followers click on the links you send out.

5 – Turn On ClickWatch

ClickWatch is a program designed to provide a level of protection for advertisers who engage Tweeters in the Sponsored Tweets marketplace. When a Tweeter participating in ClickWatch makes a sponsored tweet the system checks the click performance of that tweet after 48 hours. If the cost per click (CPC) for that tweet is above $1.50 the system will automatically schedule another tweet. The system will check performance again after another 48 hours and make a 3rd tweet if necessary.

Advertisers are lot more likely to order paid tweets from a Tweeter who has ClickWatch on rather than someone who has it off. You can tun on ClickWatch in your Sponsored Tweets control panel.

6 – Monitor The Competition

Wondering if your paid tweet price is too high or too low? You can find out by checking out your competition. Sponsored Tweets maintain a list of tweeters and how much it cost to advertise with them. You don’t have to be an advertiser to view the list.

I’ve made three price adjustments to my tweet price since signing up with Sponsored Tweets. These adjustments help to maintain my competitiveness. Sponsored Tweets gives you a recommend price when you first sign up. However, you don’t have to take it. The best way to set the price is to see what the competition is charging and then charge accordingly.

7 – Maintain a Good Followers to Friends Ratio

When an advertiser views your Sponsored Tweets profile, they’re presented with some key information about you. One piece of info is the Ratio. This show the number of people you’re following vs. the number of people following you. A Ratio of 1 means you follow the same number of people as the number of people following you. It can also mean you’re using auto following programs to inflate your follower count.

From an advertiser standpoint, the higher the Ratio number, the better. It tells the advertisers that your followers are following you because they want to hear what you have to say and not because you will auto follow them back.

8 – Sign Up for a Klout Account

Another stat Sponsored Tweets advertisers see is your Klout score. The Klout Score is a numerical representation of the size and strength of your sphere of influence on Twitter. The size of your sphere of influence is calculated by measuring true reach (engaged followers and friends vs. spam bots, dead accounts, etc).

The strength of influence is the likelihood that someone will listen or act upon any specific message and is measured by looking at interactions across the social graph. The scores range from 1-100 with higher scores representing a wider and stronger sphere of influence. Here’s the key. Unless you sign up for a Klout account, your score shows up as zero in the Sponsored Tweets page.

9 – Build Real Influence

If you thought that the way to make money with Sponsored Tweets was to build a big list by auto following and unfollowing thousands of people, think again. Advertisers are not dumb. They know how that game works. They’re looking for Tweeters with real influence. That means you actually have to work to build up your Twitter profile instead of letting a program do it. It means you have to get people to follow you because they want to follow you and not because you’ll auto follow them back. When you have real influence, you’ll have a lot of more offers, you’ll command a higher price per tweet and you’ll be able to do step 10.

10 – Apply for Celebrity Status

When advertisers search for tweeters to advertise with, Sponsored Tweets list the stars and web celebrities first. It goes without saying that being listed on the first page will give you a lot more exposure and therefore a lot more offers.

Sponsored Tweets monitors new Tweeters as they sign up. If they recognize your name they will automatically upgrade you to Internet Celebrity. If not you will need to fill out a form. Pass along things like your Wikipedia page, Blog, YouTube Channel or other relevant sites. Having a bunch of followers on Twitter does not automatically make you a Web Celeb. Acceptance into the program requires influence, visibility and marketability.

If you can’t get celebrity status, then asked to be a “staff pick” as they’re listed right after web celebrities.

Make money online is not an easy business. We present 5 tips that can make the job of making money online much easier.

Make money online is the reason why so many blogs or internet marketing websites exist. Some make money online easily and some struggle to cover the basic costs of maintaining a web presence.

Although many factors are important so as to make money online there are 5 tips or guiding lines that any successful business should follow to make money online. There is no guarantee on how much money can you make but these 5 tips will make your money making adventure more pleasant.

Make money online tip 1: What is the answer to your customers needs?

We do not expect to make a demographics survey or statistical analysis but knowing your visitors or readers if you run a blog is very crucial. Think like your visitors. Does your content make them really have an interest in your offers or products? Out of thousands websites they have visited what is the unique feature of your business that will gain instantly their attention?

How will you convince them that you have what they are searching for? Think of your content in terms of being a potential customer. Would you buy from your website if you were a random visitor?

Make money online tip 2: Who are your customers?

Do you present a generic website for everyone online or does your website is suitable for specific products and searches like geographical restrictions on vacations? You need targeted visitors or just visitors that will browse through your online business and depending on web traffic you will make sales?

Make money online tip 3: How will you make a sale?

Now that you have answered with success to what is your web site about and who are really your potential customers you need to define how will you make in fact a real sale. Do you have a unique offer? Do you have an exclusive product or service? Do you make a gift with any other purchase or have free shipping? What is the link bait that makes your website interesting?

Make money online tip 4: Attention, Interest, Desire, and Action.

AIDA or Attention, Interest, Desire, Action is a proven sales technique that speaks directly to the needs of any customer increasing the odds that a sale will occur. There are many free articles on the Internet about AIDA approach in sales but the main points are to create the attention of your online visitors from the start, giving them an answer to their search. After all they landed on your pages for searching something, give then in an interesting way grabbing their attention that your website is what they are looking for. You can give then all the information, advice, answers that any visitor to your website is looking for so you save them form time and effort. And since time is money ask them to trust you and buy your goods or services. So ask them for action. The AIDA approach seems very sophisticated while in reality it is very simple and effective. It is like when you want to ask for the first time someone on a date. You can spend days, weeks, months searching for the right words or action while a simple straightforward approach would save you from anxiety and time giving you immediately a positive or negative answer. Simplicity is the key to success and in sales.

Make money online tip 5: never stop searching the web for new ideas.
